Motel 6 Settles In $8.9M Class Action Suit For Handing Latino Guests’ Names To ICE

Imagine checking into a hotel and having Immigration and Customs Enforcement (ICE) called on you. That is what happened to several Latino guests at various Motel 6 establishments.

So the guests sued in a class-action lawsuit and won. Now Motel 6 will have to pay nearly $9 million to the lawsuit filed by a Latino civil rights organization, Mexican American Legal Defense and Educational Fund (MALDEF).

“Under the proposed settlement, the Carrollton-based company will compensate Motel 6 guests whose names were submitted to ICE, including some who were questioned by ICE or placed in deportation proceedings.

At least one person was deported as a result, according to an attorney in the case,” Dallas News reported.

In 2017, G6 Hospitality LLC, the parent company of Motel 6, admitted that two of its Phoenix-area sites gave guest information to ICE. Motel 6, however,  said the parent company had no idea this was going on.

“The proposed settlement, which allots up to $7.6 million for plaintiffs and additional funds to cover fees, applies to corporate and franchised Motel 6 locations nationwide,” Dallas News reported.

ICE arrested about 20 unauthorized immigrants who were staying at two Motel 6 locations between February and August, the Phoenix New Times reported.

A similar situation happened in Washington at six corporate-owned Motel 6 locations.

After the revelation, the Mexican American Legal Defense and Educational Fund and a law firm filed suit in the U.S. District Court for the District of Arizona on behalf of eight plaintiffs identified in the complaint with pseudonyms “out of concern about [them] facing potential repercussions,” said Thomas Saenz, the legal defense fund’s president and general counsel. The suit cited violations of guests’ privacy.

Motel 6 issued a statement:

“In September 2017, when this issue emerged, the company launched an investigation and issued a clear directive to all locations nationwide, emphasizing that the practice is prohibited. Motel 6 fully recognizes the seriousness of the situation and accepts full responsibility for both compensating those who were harmed and taking the necessary steps to ensure that we protect the privacy of our guests.

Besides monetary compensation, Motel 6 agreed to have oversight over its locations to protect private information. This agreement will be good for at least two years.

And after all of the damages are made to the victims, the “remaining funds will go to nonprofit organizations serving immigrants through legal aid and scholarships,” New Times reported.
